The AIF Regulation establishes a general framework for the regulation and supervision of such third-country firms, including the requirements imposed on EU and third-country regulatory authorities, for the establishment of cooperation and information exchange agreements. The operational details of these provisions were provided by European Commission (the “Commission”) Level 2 Delegated Regulation No 231/2013 (the “Level 2 Regulation”) adopted in December 2013. The agreed cooperation agreements were to be concluded until the manager`s implementation date of 22 July 2013. The AMF recalls that, in addition to the signing of bilateral cooperation agreements to the AIFM by the AMF, all the above-mentioned activities remain subject to different requirements defined in the Directive. Before participating in such activities, managers must therefore ensure that they meet all requirements.
